Terms and Conditions

The offer and sale of the products on the WebShop Il Castagneto constitutes a distance contract governed by the Legislative Decree 6 September 2005, n. 206 (“Consumer Code”), in particular art. 45 et seq., and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce.

By submitting the order, the user confirms the knowledge and full acceptance of these General Conditions of Sale.

These conditions are valid from 01/03/2021. It is recommended that you print and keep them.

The price of the published products are expressed in Euro and are inclusive of VAT.

The purchase of products on the Il Castagneto WebShop takes place after registration on the Site, and is allowed both to users who have the quality of consumers, and to users who do not have this quality. Individuals are allowed to purchase only on condition that they are at least eighteen years old.

To finalize the purchase contract for one or more products, the user must complete an order in electronic format and transmit it to the Seller electronically via the platform, following the instructions that will appear from time to time. Before proceeding with the transmission of the order, the user can identify and correct any data entry errors by following the instructions, or modify the order.

The Seller reserves the right to change the price of the products at any time, without notice, it being understood that the price charged to the user will be that indicated at the time the order is placed.

Delivery to Cash:
Payment upon delivery of the goods. For cash on delivery there is a surcharge of 6 Euros. For cash on delivery shipments, the courier accepts only cash payment and does not allow the package to be opened for inspection before payment. In the event that the delivery is not successful or the goods are not collected, a request will be sent to you by our credit recovery office for the payment of expenses as described in the paragraph “Refused packages or Absent Recipient“.

Bank transfer:
When ordering, you will receive a confirmation email with bank details (IBAN) to make the transfer. The goods will be shipped as soon as we have evidence of the successful outcome of the transfer.

PayPal and Credit Card through Paypal:

Sending a payment with Paypal is safe and immediate and is carried out on the secure servers of Paypal, a company that offers a system of online micropayments by credit card, acting as an intermediary between the user and the recipient of the payment.

From today it is also possible to pay with Paypal even without registering an account. Payments with VISA, VISA ELECTRON, MASTERCARD, CARTA AURA credit cards are accepted. To proceed with the payment by credit card despite not having a Paypal account, when confirming the order, select the payment method Credit card with Paypal and, when the payment window opens, enter your credit card details as shown in the image below:

ATTENTION: In the case of using a new credit card, Paypal could initiate a verification procedure of the card by charging the same amount of 1 dollar which will be automatically re-credited within 24 hours.

The shipment of the goods, by express courier, usually takes place within 1-2 working days from receipt of payment.

Delivery to the address provided upon completion of the purchase form usually takes place no earlier than the next 24/48 hours (72 hours for Disadvantaged and Abroad Zip Codes) from shipment. At the time of shipment you will be sent the shipment code and the link to the courier’s website for online tracking.

The courier makes 3 delivery attempts. If the customer is not available at the third attempt, the goods are returned to the sender.

Costs:

Shipping costs are determined by the WebShop during the order phase, automatically according to the weight of the package (s) and the place of destination of the goods. There is no surcharge beyond the recovery of the cost requested by the courier.

The weight ranges (including packaging) considered for ITALY are: A) 0-5,000 Kg, B) 5,001-10,000 Kg, C) 10,001-22,000 Kg, D) 22,001-50,000 Kg, E) 50,001-100,000 Kg.

The places of destination are grouped into zones: a) Sardegna, b) Venezia-Isole minori, c) Calabria-Sicilia, d) Italia (restanti parti d’Italia), e) Europa (Austria, Germania, Danimarca, Belgio, Lussemburgo, Olanda, Francia, Spagna, Finlandia, Ungheria, Lituania, Lettonia, Estonia, Polonia, Svezia, Bulgaria, Romania, Repubblica Ceca, Slovacchia, Slovenia, Croazia).

The minimum shipping cost for ITALY is € 8.80 (corresponding to the weight range A) and destination d) Italia). The maximum shipping cost is € 51.20 (corresponding to the weight range E) and destination b) Venezia-Isole minori).

The minimum shipping cost for EUROPE is € 22.10 (corresponding to weight range A) and to Europe – Germany destination). The maximum shipping cost is € 63.90 (corresponding to weight range D) and to the destination Europe – Finland).

Refused packages or Absent Recipient:

In case of refusal of a package sent to a registered customer, we will ask the customer for a reimbursement of expenses of Euro 30.00 (in addition to the value of the goods if perishable) necessary to cover all shipping, storage and communication costs. The reimbursement costs must be paid within 7 days from the date of request through one of the payment methods described above. Failure to pay the reimbursement of expenses or the unavailability of the debtor user, will see us forced to contact a credit recovery company, which will recover the credit by legal means. In this case, the expenses pertaining to the company in question will be added to the amount due. The same thing also applies to a non-delivery due to the absent recipient or due to an incorrect address.

The goods will travel with a “sales and transport document” documenting the purchase. If the customer is interested in receiving an invoice, he must specify this in the order phase and communicate the data necessary for the issuance of the same such as company name, address, postcode, town, VAT number. and tax code.

You will be contacted by phone or e-mail, within 3 days of receiving the complaint, to share the complained problem together and quickly define a solution together.

In recent years we have responded to all the reports received, always finding a shared solution and resolving any dispute. However, should a satisfactory and mutual agreement not be reached, the consumer can still use the formula in accordance with the law, also taking into account that a European platform has been set up for the online resolution of consumer disputes (so-called ODR platform) :Online dispute resolution

The customer of the WebShop Il Castagneto online store acting as a “Consumer”, as defined in Article 3 of the Consumer Code, is entitled to the rights referred to in art. 54 of the Consumer Code and as amended by the 2013/83 EU decree within the limits set by this legislation and therefore has the right to withdraw from the Purchase Agreement for any reason, without explanation and without any penalty, in the manner specified below.
It should be noted that this right is reserved only to natural persons, that is to those private consumers who act for purposes unrelated to their profession.

The consumer has the right, within 14 days of receipt of the products purchased, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without the need to specify the reason.

This law applies to all products purchased online on the website www.il-castagneto.it. For obvious health reasons, conservation, perishability and consumer health safety, it will not be possible to exercise the right of withdrawalfor all food products that are defined as perishable, fresh, cured meats, meats of all kinds and processing, cheeses, dairy products, fruit and vegetables, even if vacuum-packed or in a protective atmosphere.

The return costs are fully at our expense.

The right of withdrawal is totally lost if the returned product is not intact, or because the product has suffered damage for reasons other than transport from us to the consumer, not previously reported.
Without limitations on the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse delivery or accept it with express reservation.

The right of withdrawal is exercised by means of an explicit declaration within the aforementioned period of 14 days from receipt of the goods, to be sent by post or e-mail to:

This communication must contain the codes of the products to be returned and the date on which they were purchased, as well as information on how to reimburse the expense incurred and any bank details.
The products subject to reconsideration must be returned in conditions of substantial integrity and in their original packaging. After receiving your communication, you will be sent instructions for returning the goods.

Once we have received the goods and verified their integrity, we will, as soon as possible, and in any case no later than 14 days from receipt of the notice of withdrawal, to credit the customer with the cost of the returned products.
